Did you know that Tribal documents are treated differently than states’ documents in federal court? In federal court, documents must be authenticated before being considered by the judge. Federal Rule of Evidence (FRE) 902 addresses documents from entities considered “self-authenticating.” Historically, this has excluded all Tribes, including Alaska Native Tribes, and requires additional evidence to prove authenticity of Tribal documents in federal cases. An amendment to this rule is being considered that would include federally recognized Tribes as entities whose documents are self-authenticating.
